These Terms of Sale govern all purchases made through the Eloreiah website. By placing an order, you acknowledge that you have read, understood, and agreed to these Terms of Sale.

2. Products

We make every reasonable effort to provide accurate product descriptions, photographs, sizing information, materials, and specifications. Minor differences in colour, fabric texture, appearance, or finish may occur due to lighting conditions, screen settings, production processes, or normal manufacturing variations and do not necessarily constitute product defects.

3. Prices

All prices displayed on our website are shown in Euros (€). Where required by applicable law, displayed prices include VAT. Any applicable shipping charges are shown during checkout before payment is completed.

We reserve the right to update prices, promotional offers, discounts, and product availability at any time. Any price changes will not affect orders that have already been accepted, except where required to correct an obvious pricing error.

4. Orders

When you place an order, you are making an offer to purchase the selected products subject to these Terms of Sale. An order is considered accepted once payment has been successfully authorized and an order confirmation has been issued.

We reserve the right to refuse, limit, or cancel an order where we reasonably suspect fraud, unauthorized activity, pricing errors, stock shortages, payment issues, or legal and regulatory compliance concerns.

5. Payment

Payments are securely processed through trusted third-party payment providers. We do not store your complete payment card details.

Available payment methods are displayed during checkout and may vary depending on your location, currency, device, and payment provider availability.

6. Shipping

  • Orders are generally processed within 1–2 business days.
  • Estimated delivery times are provided in our Shipping Policy and, where applicable, during checkout.
  • Tracking information will normally be sent by email after your order has been dispatched.
  • Delivery dates and times are estimates and may be affected by courier operations, customs procedures, weather, peak periods, or other circumstances beyond our reasonable control.

7. Returns & Refunds

Eligible customers may request a return within 60 days of delivery, subject to the conditions set out in our Return & Refund Policy.

Unless otherwise required by applicable consumer law, returned products must be unused, unworn, unwashed, and in their original condition, including original tags and packaging where applicable.

8. Customer Responsibilities

You are responsible for providing accurate and complete billing, shipping, and contact information when placing an order. Eloreiah cannot be held responsible for delivery delays, failed deliveries, or additional costs resulting from incorrect or incomplete information provided by the customer, except where applicable law provides otherwise.

9. Warranty

Products may be covered by our Warranty Policy and any statutory legal guarantees applicable under French or European consumer law. Any commercial warranty offered by Eloreiah is additional to, and does not replace or limit, mandatory consumer rights.

Where applicable, our commercial warranty does not cover damage caused by misuse, accidents, improper care, normal wear and tear, unauthorized alterations, or failure to follow product care instructions.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Eloreiah and SARL Delta Voiles Côtes d’Armor shall not be liable for indirect, incidental, consequential, or special losses arising from the purchase or use of our products or website where such liability may legally be excluded.

Nothing in these Terms of Sale excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protection rights.

11. Force Majeure

We shall not be responsible for delays or failures to perform our obligations where these result from circumstances beyond our reasonable control, including natural disasters, strikes, transportation disruptions, customs delays, governmental actions, major technical failures, cyber incidents, public health emergencies, or other force majeure events recognized under applicable law.

12. Consumer Rights

Nothing in these Terms of Sale limits or excludes any mandatory consumer rights available under applicable law. Where national or European consumer protection legislation provides customers with additional or stronger rights, those statutory rights shall apply.

13. Governing Law

These Terms of Sale are governed by and interpreted in accordance with the laws of France, without depriving consumers residing in another country of any mandatory consumer protections available to them under applicable law.

14. Changes to these Terms of Sale

We may update these Terms of Sale from time to time to reflect changes in our products, services, business operations, or legal obligations. The version applicable to your purchase will generally be the version in effect when your order is placed.
